This bill, known as "The Protection of Women's Sports Act," requires any interscholastic, intercollegiate, or club athletic team, sport, or athletic event sponsored or sanctioned by a school, school district, activities association, or institution of higher education to be designated based on the biological sex at birth of the participating athletes. The bill restricts those participating in sports designated as "female" to biological females. The bill also establishes a cause of action for athletes who suffer harm as a result of a violation of this requirement, allowing them to seek injunctive relief and other equitable relief against the responsible entity. Additionally, the bill provides a cause of action for schools, school districts, or institutions of higher education that suffer harm as a result of a violation of this requirement.

The bill also includes provisions regarding the statute of limitations for bringing a civil action, stating that such actions must be initiated within 2 years from the date the alleged harm occurred. It also allows the prevailing party in a claim brought under this bill to be awarded reasonable attorney's fees and costs. The bill is set to take effect on July 1, 2024.
