This bill prohibits the sale of lithium-ion batteries and electric bicycles or electric scooters that have not been certified by a nationally recognized testing laboratory. It defines "lithium-ion battery" as a storage battery that generates an electrical current using lithium ions, and "second-use lithium-ion battery" as a battery that has been assembled or reconditioned using cells from used batteries. The bill also defines "electric scooter" as a personal device with no more than 3 wheels that is powered by an electric motor.

Under the bill, it is illegal to manufacture, distribute, or sell in the state any lithium-ion batteries or chargers for electric bicycles or electric scooters that have not been certified by a nationally recognized testing laboratory. The certification or logo of the testing laboratory must be displayed on the packaging, documentation, or product itself. Violations of this provision are punishable by civil fines. The bill also prohibits the distribution, sale, or offer for sale of second-use lithium-ion batteries intended for use in electric bicycles, electric scooters, limited-use motorcycles, or powered mobility devices. Violations of this provision are also punishable by civil fines. The bill requires that every electric bicycle and electric scooter for sale in the state be equipped with a battery that has been tested and approved by a nationally recognized testing laboratory. The bill also prohibits the attachment of counterfeit certification labels and imposes civil fines for violations. The bill will take effect on January 1, 2025.
