If the birth mother chooses to limit the disclosure, her decision will be documented in her medical record, and all personal identifiers will be redacted before any statistical information is shared with the Department of Health and Human Services.
Additionally, the bill requires the Department of Health and Human Services and the Division of Vital Records to update their memorandum of understanding to reflect these new practices. Specifically, it inserts a requirement that by November 1, 2026, the agencies must amend the memorandum to ensure that only the minimum amount of personal information from birth worksheets is shared and that the notice and consent requirements outlined in the new paragraph regarding the birth worksheet are implemented. The bill will take effect 60 days after its passage.
