This notification is to be provided before the execution of any purchase and sale contract, and the buyer must acknowledge receipt of this information by signing a copy of the notification. The bill includes a new section on PFAS, explaining that these chemical compounds have been found in various settings and have been detected at levels exceeding federal and/or state advisories or standards in wells throughout New Hampshire, particularly in the southern part of the state. It advises that water testing by an accredited laboratory can measure PFAS levels and help inform the buyer's decision regarding the need for water treatment systems.

The bill introduces an insertion to the existing law by adding PFAS to the list of contaminants that sellers must disclose, and it deletes the word "and" before "Lead" to accommodate this addition. The effective date of the act is set for January 1, 2025, as approved on July 3, 2024. This means that starting from the effective date, the new requirements for notification about PFAS contamination will be in force for all relevant real estate transactions.
