This bill amends the requirements for obtaining approval to increase the load on a sewage disposal system. It modifies the introductory paragraph of RSA 485-A:38, I, by deleting the phrase "occupying any existing structure on a full-time basis" and inserting "any change in use," which clarifies that approval is required for any change in use of a structure that would increase the load on the sewage system. Additionally, the owner must submit an application for approval of the sewage disposal system to the department, which includes specific criteria.
Further amendments are made to RSA 485-A:38, II-a(a)(1)(B)-(C), which now state that approval can be granted if the lot is 5 acres or more and is served by a sewage disposal system that has received construction and operational approval from the department, or if the lot is served by a sewage disposal system with an off-lot effluent disposal area that has also received the necessary approvals from the department. The act is set to take effect 60 days after its passage, with an approved date of July 03, 2024, and an effective date of September 01, 2024.
