This bill amends current law to provide an opportunity for the advisory council on child care to review decisions made by the department of health and human services regarding child day care licensing violations. The bill states that any applicant, licensee, or permittee who is aggrieved by a decision to suspend, revoke, deny, or refuse to renew a license or permit may appeal to the commissioner. The commissioner may appoint hearings officers to preside over these appeals, and the hearings officer may affirm, deny, or modify the department's decision. The bill adds that the procedures for the appeal process shall include the opportunity for review of the department's decision by the advisory council on child care, at the request of the applicant or licensee. The findings and recommendations of the advisory council shall be presented to the hearings officer prior to issuance of a final decision.
The bill also adds a new subparagraph to the advisory council on child care's responsibilities. The new subparagraph states that the advisory council shall review department decisions regarding child day care licensing violations. The bill will take effect 60 days after its passage.
