This bill establishes the crimes of unlawful distribution of misleading synthetic media and unlawful distribution of election-related misleading synthetic media. It defines "synthetic media" as any form of media created or modified using artificial intelligence algorithms.

Under this bill, a person is guilty of unlawful distribution of misleading synthetic media if they distribute or make publicly available synthetic media of or by an identifiable person without their consent, without displaying a notice identifying the media as synthetic, and with the intent to mislead others about the acts of the identifiable person.

A person is guilty of unlawful distribution of election-related misleading synthetic media if they distribute or make publicly available synthetic media of or by an identifiable person within 90 days of a state, county, or local election without the person's consent, without displaying a notice identifying the media as synthetic, and with the intent to injure a candidate or influence the result of an election.

Unlawful distribution of misleading synthetic media is a class A misdemeanor, while unlawful distribution of election-related misleading synthetic media is a class B felony for repeat offenders or if the media is distributed with the intent to provoke violence. The bill will take effect on July 1, 2024.
