This bill adds new definitions to the Hazardous Waste law in New Hampshire. It defines "PFAS" as perfluoroalkyl and polyfluoroalkyl substances, "Perfluoroalkyl substance" as a chemical with fully fluorinated carbon atoms, "Polyfluoroalkyl substance" as a chemical with at least one fully fluorinated carbon atom and at least one carbon atom that is not fully fluorinated, and "Fully fluorinated carbon atom" as a carbon atom with all hydrogen substituents replaced by fluorine.

The bill also adds a new paragraph to the Hazardous Waste law that imposes liability on any person who owns or operates a PFAS facility where a release of PFAS has resulted in concentrations in groundwater or surface water of 100 parts per trillion or greater. These persons will be subject to federal regulations regarding the closure, removal from service, or decommissioning of tanks, piping, containers, manufacturing equipment, waste or wastewater treatment infrastructure, air pollution control devices, and the interior and exterior surfaces of PFAS facility buildings and structures. This provision does not limit the applicability of other sections of the Hazardous Waste law to releases of PFAS. The bill will take effect 60 days after its passage.
