This bill amends current law regarding the determination of parental rights and responsibilities in cases involving minor children. It states that if the court finds that a minor child is mature enough to make a sound judgment, the court may give substantial weight to the child's preference regarding parental rights and responsibilities. The court must also consider other factors that may have influenced the child's preference, such as undesirable or improper influences.
The bill adds that if the child has a therapist, the court must also consider the therapist's assessment of the child's maturity in determining the weight to give the child's preference. This applies to both the determination of parental rights and responsibilities and the modification of parental rights and responsibilities. The bill will take effect 60 days after its passage.
