This bill modifies the requirements for the operation of and equipment required for all classes of electric bicycles. It states that electric bicycles capable of speeds of 15 mph or faster with the assistance of electric motor and battery power cannot be operated on any sidewalk, bike path, or rail trail. They must also be subject to all motor vehicle laws, rules, and regulations of the roadway when being operated on a public way. Electric bicycles may be required to be registered with the division of motor vehicles. The bill also requires manufacturers and distributors of electric bicycles to apply a label containing classification number, top assisted speed, and motor wattage to each electric bicycle. The label must be permanently affixed in a prominent location and printed in at least 9-point type. The bill also includes requirements for safety equipment and age restrictions for operating electric bicycles.
Additionally, the bill classifies electric scooters and electric unicycles as motorized vehicles and restricts their use on any way, sidewalk, bike path, or rail trail within the state. The bill also requires the director of the division of motor vehicles to develop procedures for the registration of electric bicycles, electric scooters, and electric unicycles by January 1, 2025. The director must report the proposed procedures to the speaker of the house of representatives, the senate president, the chairs of house and senate committees with jurisdiction over vehicle licensing, and the governor. The effective date of the bill is July 1, 2024.
