This bill prohibits false and misleading "recyclable" labeling on plastic products. It adds a new subdivision to RSA 149-M, which defines terms related to recycling logos. It defines terms such as "plastic," "chasing arrows symbol," "label," "person," "plastic bottle," and "plastic container." The bill makes it unlawful for a person to make an untruthful, deceptive, or misleading claim that a plastic consumer good is recyclable. It also prohibits the manufacture or distribution of a plastic container or plastic bottle with a chasing arrows symbol or label stating that the plastic consumer good is recyclable unless the recycling rate for that consumer good and its packaging is 75 percent, as determined by the Department of Environmental Services. The bill also establishes record-keeping requirements for persons claiming that a plastic consumer good is recyclable. The bill provides for enforcement and rulemaking by the Department of Environmental Services and the Department of Justice. The bill takes effect on January 1, 2025. The bill may have an impact on the judicial and correctional systems, as well as the Department of Environmental Services, which may require additional resources to enforce the provisions of the bill.
