This bill amends the requirements for submitting excavating and dredging permit applications by changing the format in which these applications must be provided to municipalities. Previously, applicants were required to submit four copies of the form and attachments. The bill changes this requirement, mandating that applicants now submit one paper copy and one digital copy of the form and attachments. The digital copy must be provided in a PDF or another digital format approved by the department.
The bill specifies that the town or city clerk is responsible for sending a copy of the form and attachments to the local governing body, the municipal planning board, and the municipal conservation commission, as applicable, and for retaining a copy that is reasonably accessible to the public. For state agency projects, the application and fees may be filed directly with the department, accompanied by one paper and one digital copy of the application, plan, and map, which must also be filed with the town or city clerk. The act is set to take effect 60 days after its passage, with an effective date of July 19, 2024.
