This bill prohibits smoking and e-cigarettes in motor vehicles when a passenger under the age of 16 is in the vehicle. It adds a new section to RSA 265, stating that no person shall smoke tobacco products or e-cigarettes in a motor vehicle when a child under the age of 16 is present. The fine for a violation of this section is $100. Police officers can only enforce this provision as a secondary action when detaining a driver for a suspected violation of another provision of Title XXI. The bill will take effect 120 days after its passage.
