This bill requires that restaurants designed to seat 50 or more patrons have at least 2 separate toilet rooms. It also eliminates the requirement for separate bathrooms to be gender-specific.
The bill amends RSA 155:40, I to state that all places where the business of serving food to the public is conducted must be equipped with toilet and lavatory facilities convenient of access for the use of patrons. At least 2 separate toilet rooms shall be provided for patrons of any restaurant designed to seat 50 or more patrons at one time or for patrons of any food establishment where alcoholic beverages are served. The commissioner of the department of health and human services has the authority to waive these requirements for businesses with 5 or fewer seats if they can show that they are unable to comply and that the requirements would cause substantial hardship. The bill will take effect 60 days after its passage.
