This bill, known as the Firearm Purchaser's Privacy Act, prohibits the assignment of a specific merchant category code, known as a "firearms code," to transactions involving the sale of firearms, ammunition, or firearm accessories. It mandates that firearms retailers, defined as any person or entity in the state engaged in the lawful sale of these items, may only use or be assigned a merchant category code for general merchandise or sporting goods retailers. The bill outlines the definitions relevant to electronic payment transactions, firearms codes, firearms retailers, payment card acquirers, issuers, and networks.

The bill also establishes the authority of the Attorney General to investigate and enforce violations of this chapter. It provides a mechanism for the Attorney General to issue subpoenas and examine witnesses and documents. If a violation is found, the Attorney General must notify the violator and allow them 30 days to cure the violation and make policy changes to prevent future occurrences. Failure to cure the violation or a breach of the written statement provided to the Attorney General can result in the Attorney General seeking an injunction and recovering a civil penalty, attorney's fees, and other expenses. The act is set to take effect on January 1, 2025.
