This bill adds restrictions on the use of personal information from driver licenses. It defines "motor vehicle records" to include personal information or Real ID status contained in them. It also defines "personal information" to include a person's photograph or computerized image, date of birth, social security number, driver identification number, name, address (excluding the 5-digit zip code), telephone number, and medical or disability information.

The bill prohibits private businesses from electronically capturing, retaining, copying, or placing personal information from a driver license on or in a consumer file. It also prohibits sharing personal information derived from the inspection of a driver license with any governmental or other entity without a judicial order. Any private business that shares personal information from a driver license or facilitates the loss or compromise of such information due to a breach of security will be required to pay a penalty of $10,000 to the individual whose information was shared, lost, or compromised. The bill also allows individuals to pursue a consumer protection act case against any entity requesting a copy of a driver license or other information from the license. Exceptions are made for certain individuals, such as notary publics and real estate commissioners, who may retain a copy of a driver license for identification and official record keeping. The bill will take effect on January 1, 2025.
