This bill amends the regulations regarding the use of tree stands, observation blinds, and pit blinds on another person's land. It specifies that no person may erect, build, or use these structures in a way that damages or destroys trees without express written permission from the property owner or their designee. Additionally, the bill prohibits the cutting of any trees in connection with these activities without similar permission. The bill introduces new provisions, including the requirement for all tree stands and observation blinds to be labeled with the owner's name and contact information in a clearly visible manner. It also sets a timeframe during which portable or temporary tree stands or observation blinds may be erected on another's land without violating certain paragraphs, specifically from April 25 to June 1 and from August 1 to December 31, with the requirement that they be removed by June 1 unless permitted by the property owner.
The bill further outlines that property owner permits for these structures expire annually on December 31 unless rescinded earlier. It establishes that violations of these regulations will result in the perpetrator being liable for damages caused and subject to fines levied by the fish and game department. The bill also empowers property owners to contact law enforcement or conservation officers to remove and seize any tree stand or observation blind placed or not removed in violation of the regulations. The effective date of the act is set for January 1, 2024.
