This bill proposes changes to the residency requirements for individuals serving as deputy town clerks. It amends RSA 41:18 to allow a deputy town clerk to be qualified for the position without being domiciled in the town. This change means that while the deputy town clerk must meet other qualifications similar to the town clerk, they are no longer required to live within the town they serve. The duties of the deputy town clerk remain the same, including stepping in for the town clerk in cases of absence due to sickness, resignation, or other reasons, with the appointment made by the elected town clerk and approved by the selectmen.
Additionally, the bill amends RSA 669:65 regarding the process for filling vacancies in the office of town clerk. In towns where a deputy town clerk has been appointed, the deputy will serve as town clerk until the next annual town election. However, if the deputy does not reside in the town, the vacancy may, instead of shall, be filled by an appointment made by the selectmen. This provides flexibility in appointing a town clerk when the deputy is not a resident. The act will take effect 60 days after its passage.
