This bill adds a new section to RSA 402, which relates to the standard of care for insurance agents. The new section states that in a civil cause of action brought against an insurance producer regarding the sale, placement, procurement, renewal, binding, or cancellation of property and casualty insurance, the insurance producer will not be barred from asserting any defenses available at common or statutory law. The bill also clarifies that this provision does not invalidate any terms or conditions of a contractual agreement between an insurance producer and an insurer. The bill defines "insurance producer" as having the same meaning as defined in RSA 402-J:2. The bill also specifies that the provisions of this section do not limit or prohibit the commissioner of the insurance department from imposing duties on insurance producers as required by state or federal law. The bill will take effect on January 1, 2024.
