This bill amends the existing law regarding municipal revenue bonds and the definition of broadband infrastructure. It specifies that revenue-producing facilities, which are eligible for municipal revenue bonds, include broadband infrastructure serving locations within a municipality that are unserved by broadband or any location within a communications district formed under RSA 53-G. The bill also updates the definition of broadband in the context of municipal electric, gas, or water systems to mean transmission rates greater than or equal to 100 megabits per second download and 20 megabits per second upload, or at rates defined by the Federal Communications Commission as a wireline advanced telecommunications capability, whichever is greater.

The insertions in the bill include the specification that broadband infrastructure can serve locations within a communications district formed under RSA 53-G and the updated rates of transmission for the definition of broadband. The bill does not include any deletions from the current law. The act is set to take effect 60 days after its passage, with an effective date of September 26, 2023.
