STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty One
AN ACT requiring law enforcement agencies to gather and analyze certain demographic
information.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 1 New Section; Demographic Data Collection and Analysis. Amend RSA 105 by inserting after
2 section 19 the following new section:
3 105:20 Demographic Data Collection and Analysis. All police departments shall gather,
4 analyze, and make available to the public, at least annually, data on demographics (including gender
5 and race) for arrests, citations, motor vehicle and subject stops and searches (including frisk,
6 container search, car and residence), regardless of the disposition of the case, as well as the rationale
7 given by the participating law enforcement personnel or such stops and searches.
8 2 New Section; Demographic Data Collection and Analysis. Amend RSA 106-B by inserting
9 after section 18-a the following new section:
10 106-B:18-b Demographic Data Collection and Analysis. Law enforcement shall gather, analyze,
11 and make available to the public, at least annually, data on demographics (including gender and
12 race) for arrests, citations, motor vehicle and subject stops and searches (including frisk, container
13 search, car and residence), regardless of the disposition of the case, as well as the rationale given by
14 the participating law enforcement personnel or such stops and searches.
15 3 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill requires law enforcement agencies to gather and make available, at least annually,
demographic data for police contacts (e.g., arrests, motor vehicle stops, etc.), which appears
would likely result in increased expenditures at the state, county, and local levels in order to
comply. At this time, agencies are unclear as to the application of this proposed law in certain
circumstances and is therefore unable to estimate the extent of the impact on expenditures. It
is assumed since the effective date of this bill is 60 days after passage, impacts would first be
realized in FY 2022.
