This bill amends section 70-1034 of the Revised Statutes Cumulative Supplement, 2024, to establish new requirements for electric suppliers regarding dispatchable electricity capacity. It defines a dispatchable electric generation facility and mandates that if any public power entity decides to close or decommission such a facility with a capacity over one hundred megawatts, they must notify the Nebraska Power Review Board in writing. This notice should include recommendations for transition activities aimed at minimizing economic harm to affected workers and communities. The board may hold a hearing on the matter, and its recommendations will be advisory, requiring the entity to consider them before making a final decision.

Additionally, the bill introduces a new requirement for electric suppliers to maintain seventy-five percent of their dispatchable electricity capacity within their generation portfolio. Electric suppliers must certify their compliance with this requirement to the Nebraska Power Review Board annually. If they are found to be out of compliance, they are required to submit a plan to achieve compliance within sixty days. The bill also provides definitions for "dispatchable electricity" and "capacity" to clarify these terms within the context of the legislation. The original section 70-1034 is repealed as part of this amendment.
