This bill introduces two key acts: the Preventing Lethal Agricultural and National Threats Act and the Critical Infrastructure Protection Act. The Preventing Lethal Agricultural and National Threats Act establishes criminal penalties for the unauthorized importation of high-risk agricultural pathogens or pests, classifying violations as Class III or Class IIA felonies based on the severity of the offense. It also grants the Department of Agriculture the authority to designate certain agents or organisms as high-risk. The Critical Infrastructure Protection Act aims to protect Nebraska's critical infrastructure from foreign adversaries by prohibiting their access and control, requiring companies to register with the Attorney General, disclose ownership information, and report security breaches. The Attorney General is empowered to investigate proposed sales or transfers of critical infrastructure to foreign entities and can seek injunctions if such actions threaten state security.
Additionally, the bill introduces regulations regarding the use of prohibited network-connected technology by governmental entities and critical infrastructure providers, effective September 1, 2026. It prohibits these entities from adding such technology to their operating networks and from renewing contracts with vendors of certain traffic enforcement systems that utilize prohibited technology. The bill also amends existing laws related to public records, enhancing the confidentiality of personal information and security-related information concerning critical infrastructure. Furthermore, it updates registration requirements for communications providers, allowing the Public Service Commission to impose fines for violations and enabling the Attorney General to enforce civil penalties for non-compliance. The bill repeals outdated sections of the law to ensure the legal framework remains relevant in addressing emerging technologies and security challenges.
