Legislative Bill 47 amends section 70-1001.01 of the Revised Statutes Supplement, 2025, to introduce new definitions and regulations concerning electric generation facilities in Nebraska. The bill defines terms related to electric vehicle charging stations, electric suppliers, and renewable energy generation facilities. Notably, it prohibits electric suppliers from retiring, shutting down, ceasing operation, or substantially altering the operation of any electric generation facility or privately developed renewable energy generation facility if there are customers waiting for electric service. Exceptions to this prohibition include situations where such actions are mandated by law, the facility is unsafe, it has been damaged beyond repair, or its continued operation is deemed uneconomical.

Additionally, the bill requires that before any retirement, shutdown, cessation, or alteration can take place, the governing body of the electric supplier must identify the reasons for such actions in a resolution, which must include at least one of the specified reasons outlined in the bill. This legislative change aims to ensure reliability in electric service provision while also addressing the operational integrity of electric generation facilities in the state. The original section 70-1001.01 is repealed as part of this amendment.
