The Act defines key terms such as "camp," "campsite," and "state funds," and establishes that it is unlawful for individuals to camp in public properties or rights-of-way that are not designated as campsites or temporary sites for unsanctioned homeless encampments. Violations of this provision are classified as Class V misdemeanors, although first-time offenders may be directed to the nearest appropriate shelter instead of facing prosecution.

Additionally, the Act prohibits political subdivisions from allowing unauthorized camping and mandates that law enforcement and prosecuting attorneys enforce these regulations. It provides a mechanism for individuals aggrieved by violations to bring civil actions against political subdivisions, including the potential for recovering legal costs. Furthermore, if a political subdivision is found in violation of the Act, the Department of Health and Human Services will notify the State Treasurer to suspend state fund distributions to that subdivision, with penalties for continued non-compliance. The Act includes a severability clause and is set to take effect immediately upon passage due to the declared emergency.
