This bill amends sections 28-306 and 28-394 of the Revised Statutes Supplement, 2025, to enhance penalties for motor vehicle homicide and motor vehicle homicide of an unborn child when such incidents are proximately caused by violations related to the use of wireless communication devices. Specifically, it introduces new legal language that classifies motor vehicle homicide as a Class IIIA felony if the death results from violations of certain specified sections, including 60-6,179.01 and 60-6,179.02. Additionally, it establishes that if the death is caused by violations of sections 60-6,196 or 60-6,197.06, the offense can escalate to a Class IIA felony or a Class II felony for repeat offenders.
The bill also outlines the consequences for offenders, stipulating that for certain convictions, the court may impose a driving prohibition of up to two years, while for more severe offenses, the prohibition can extend to fifteen years. The court is required to revoke the operator's license for the same duration as the driving prohibition for serious offenses. Furthermore, the bill clarifies that these crimes will be treated as separate offenses from any other violations committed during the incident. The original sections 28-306 and 28-394 are repealed as part of this legislative update.
