This bill amends section 71-2490 of the Revised Statutes Cumulative Supplement, 2024, to enhance the Nebraska Opioid Recovery Trust Fund and establish a new Drug Detection and Prevention Cash Fund. The Nebraska Opioid Recovery Trust Fund will continue to include recoveries related to opioid advertising and will allocate funds for various health initiatives, including support for first responders and overdose fatality review teams. Notably, the bill specifies that funds will be transferred from the Nebraska Opioid Recovery Trust Fund to several cash funds, including the newly created Drug Detection and Prevention Cash Fund, which will focus on combating illegal fentanyl and other illicit drug activities.

The Drug Detection and Prevention Cash Fund will be administered by the Attorney General and will consist of amounts transferred by the Legislature, with the intent that no General Funds will be used. The fund will support law enforcement efforts in detecting and preventing illegal drug activities, including the acquisition of technology and public safety initiatives. The bill also includes provisions for the investment of funds in accordance with existing state investment laws. Additionally, the original section 71-2490 is repealed, and the act is declared to take effect immediately due to the existence of an emergency.
