This bill amends section 84-222 of the Revised Statutes Supplement, 2025, to transfer the administration of the Financial Fraud Victims' Reimbursement Fund from the Attorney General to the Nebraska State Patrol. The bill defines "financial transaction offense" and clarifies that "victim" includes both individuals and financial institutions. The fund will consist of assets forfeited from financial transaction offenses and will be invested by the state investment officer. Victims of such offenses can apply for reimbursement, and the Nebraska State Patrol will determine eligibility and the extent of reimbursement based on qualifying losses.
Additionally, the bill stipulates that if there are more applicants than available funds, the Nebraska State Patrol will distribute the funds on a pro rata basis according to the qualifying losses. It also establishes that funds related to financial transaction offenses will remain in the reimbursement fund for a period of thirty-six months or until all applications filed during that time are resolved, after which any remaining funds will be remitted to the State Treasurer for distribution as per the Nebraska Constitution. The original section 84-222 is repealed as part of this legislative update.
