This bill mandates that, starting January 1, 2027, all health benefit plans in Nebraska must provide coverage for the diagnosis and treatment of eating disorders. The required coverage includes medical, psychological, and pharmaceutical care, as well as nutritional counseling from licensed professionals and services across various levels of care, such as inpatient and outpatient treatment. Importantly, coverage cannot be denied based on an individual's body weight, body mass index, or previous treatment history. The bill also defines "eating disorder" according to the latest edition of the Diagnostic and Statistical Manual of Mental Disorders and outlines what constitutes a health benefit plan.
Additionally, the bill specifies that existing limitations on coverage found in section 44-794 will not apply to the mandated eating disorder benefits, ensuring that insurers cannot impose stricter treatment limitations for these benefits compared to other medical services. Utilization reviews for eating disorder treatments must be conducted by providers with expertise in this area. The Department of Insurance is authorized to create rules and regulations to implement these provisions effectively.
