This bill amends sections 43-512.12 and 43-512.13 of the Nebraska Revised Statutes to update the procedures for reviewing and modifying child support orders for incarcerated individuals. It mandates that the Department of Health and Human Services (DHHS) initiate a review of a noncustodial parent's child support order within fifteen business days of learning about their incarceration for more than 180 days. The department is required to notify both parents of this review and request financial information within thirty days. Additionally, the bill establishes a timeline for the DHHS to complete the review and notify the parties of its determination within ninety days.
The bill also introduces provisions for hearings if the DHHS finds that a decrease in the child support obligation is not warranted after the review. It allows the incarcerated parent to request a hearing within thirty days of the review's completion, with the option for the hearing to be conducted in person or virtually. The department must provide detailed notice of the hearing, including its findings and the process for submitting additional evidence. Furthermore, it clarifies that notices to incarcerated parents must be sent to both the parent's facility address and the facility administrator. The original sections being amended are repealed as part of this legislative update.
