This bill amends sections 16-901 and 17-1001 of the Reissue Revised Statutes of Nebraska to clarify the extraterritorial zoning jurisdiction for cities of the first and second class, as well as villages. It introduces provisions that allow these municipalities to exempt certain farm buildings from their zoning regulations, property use regulations, and building ordinances if such structures align with the comprehensive development plan and are consistent with anticipated long-range growth based on documented population and economic projections. The bill defines a "farm building" as a structure used for agricultural purposes on a farmstead of twenty acres or more that produces at least one thousand dollars in farm products annually.
Additionally, the bill mandates that cities and villages provide written notice to the respective county boards when proposing to adopt or amend zoning ordinances affecting their extraterritorial jurisdictions. This notice must be sent at least thirty days prior to the final decision, allowing the county board to submit comments or recommendations. However, this requirement does not apply to cities or villages located in counties with populations exceeding one hundred thousand or those that have a joint planning commission or department with the county. The original sections 16-901 and 17-1001 are repealed as part of this legislative update.
