This bill amends sections 71-436.02 and 38-2847 of the Nebraska Revised Statutes to update the licensure requirements for remote dispensing pharmacies and the verification process for pharmacists. It allows for verification of pharmacy technician activities to occur via real-time audiovisual communication systems under certain conditions, including when the pharmacist is located in a licensed pharmacy in Nebraska and when the physical product verification is conducted in person. The bill also specifies that verification can occur when the prescribed drugs are administered by credentialed individuals or when pharmacy technicians are engaged in remote dispensing.
Additionally, the bill stipulates that a remote dispensing pharmacy must be located at least ten driving miles from the nearest pharmacy and cannot be licensed as both a remote dispensing pharmacy and a traditional pharmacy. It removes the requirement for pharmacy technicians to be certified and clarifies that the supervising pharmacist must ensure onsite pharmacist presence at least once a month. The bill also emphasizes the importance of maintaining a functioning audiovisual communication system for remote dispensing to occur. The original sections of the statutes being amended are repealed as part of this legislative update.
