This bill amends section 55-117 of the Reissue Revised Statutes of Nebraska, which governs the conditions under which the Nebraska National Guard can be ordered into active service. The bill specifies that the National Guard can only be ordered into active combat in military service of the United States if Congress has declared war or called forth the Guard to execute federal laws, suppress insurrection, or repel invasions, as outlined in the U.S. Constitution. Additionally, the Governor is tasked with reviewing all current federal orders that have placed members of the National Guard into active combat to ensure compliance with this new provision.

Furthermore, the bill mandates that if the Governor finds any federal order non-compliant, he must take necessary actions to return those members to Nebraska. The Governor is also required to submit a report to the Government, Military and Veterans Affairs Committee summarizing the review and any actions taken within thirty days of completing the review. The bill defines "active combat" to include participation in armed conflict, hazardous service related to armed conflict in foreign states, and duties performed through instruments of war. The original section 55-118 is repealed as part of this legislative update.
