This bill amends the Pharmacy Practice Act in Nebraska, specifically section 38-28,104, to establish new requirements for prescription refills. It specifies that a prescription for a legend drug, which is not a controlled substance, must include detailed information such as the patient's name, drug name, dosage, quantity, and prescribing practitioner's details. Additionally, the bill introduces provisions for emergency refills when a pharmacist receives a request for a prescription refill without authorization.

Under the new provisions, if a pharmacist cannot obtain refill authorization from the prescribing practitioner, they may dispense an emergency refill of up to a thirty-day supply, or the amount dispensed on the most recent refill, whichever is less. This is contingent upon certain conditions being met, including that the refill is not for a controlled substance, is for a maintenance medication, and that the pharmacist believes that interrupting therapy could harm the patient's welfare. The original section of the law is repealed as part of this amendment.
