The Give to Enable Support Act establishes a new program designed to provide financial assistance to individuals with disabilities through the creation of the Give to Enable Support Cash Fund. This fund, administered by the State Treasurer, will accept contributions from private individuals and entities and is intended to support the Give to Enable Support Program, which will commence on January 1, 2026. Qualified individuals with disabilities will be able to apply for accounts to cover eligible disability expenses, with the State Treasurer overseeing the application process and account establishment. Importantly, the bill ensures that no General Funds will be allocated to the new cash fund.

In addition to establishing the support program, the bill amends section 77-2716 of the Revised Statutes Cumulative Supplement, 2024, to allow contributions to the Give to Enable Support Cash Fund to be deducted from federal adjusted gross income, similar to existing provisions for educational savings plans. The bill also introduces various tax code amendments, including the gradual exclusion of social security benefits from taxable income, full exclusion of military retirement benefits starting in 2022, and provisions for other specific income exclusions. Furthermore, it addresses the treatment of medical debt and capital gains from the sale of gold or silver bullion, while repealing the original section 77-2716.
