This bill amends sections 13-910 and 81-8,219 of the Reissue Revised Statutes of Nebraska to allow certain tort claims involving sexual assault of a child in school settings. Specifically, it introduces new provisions that exempt claims arising from sexual assault of a child that occurs on school grounds, in vehicles owned or leased by a school, or during school-sponsored activities from the limitations set forth in the Political Subdivisions Tort Claims Act and the State Tort Claims Act. The bill also clarifies that these exemptions apply to claims related to assault, battery, false imprisonment, and other similar acts.
In addition to the insertions regarding sexual assault claims, the bill deletes previous language that limited the applicability of these tort claims. The changes aim to harmonize the provisions of the two acts and ensure that victims of sexual assault in educational settings have the opportunity to seek legal recourse. The original sections of the statutes are repealed to implement these updates effectively.
