This bill amends sections 13-910 and 81-8,219 of the Reissue Revised Statutes of Nebraska to allow certain tort claims involving sexual assault of a child in school settings. Specifically, it introduces new provisions that exempt claims arising from sexual assault of a child that occurs on school grounds, in vehicles owned or leased by a school, or during school-sponsored activities from the limitations set forth in the Political Subdivisions Tort Claims Act and the State Tort Claims Act. The bill also clarifies that these claims are not subject to the same immunities that typically protect political subdivisions and state agencies from liability.

In addition to the new provisions regarding sexual assault claims, the bill makes several insertions and deletions to existing language. For instance, it modifies the language regarding claims related to assault, battery, and other torts, ensuring that the new exemptions for sexual assault of a child are clearly articulated. The bill ultimately aims to harmonize the provisions of the two acts while repealing the original sections that are being amended.
