The bill also introduces an annual thirty-day open enrollment period starting on the applicant's birthday, during which issuers cannot deny coverage, impose medical underwriting, or exclude benefits based on preexisting conditions.
Additionally, the bill allows for premium rate differences between individuals over and under sixty-five, provided these differences are not excessive or discriminatory. Specifically, premiums for those under sixty-five cannot exceed 150% of the premiums for similarly situated individuals who are sixty-five or older. The bill ensures that individuals under sixty-five will have the same open enrollment rights as those who are sixty-five once they reach that age. The original section 44-3614 is repealed as part of this legislative update.
