This bill amends section 70-1014.02 of the Revised Statutes Cumulative Supplement, 2024, to modify the requirements for exemptions related to privately developed renewable energy generation facilities in Nebraska. The bill outlines specific conditions under which these facilities can be exempt from certain regulatory sections, including the requirement for the facility owner to notify the board of their intent to construct, certify compliance with various environmental and safety standards, and hold public meetings to discuss the facility with local residents. Notably, the bill introduces new compliance requirements regarding materials used in the facility if located near military installations, as well as stipulations for decommissioning plans and joint transmission development agreements.

Additionally, the bill clarifies that no property associated with these renewable energy facilities can be subject to eminent domain by consumer-owned electric suppliers, while allowing such suppliers to exercise eminent domain for necessary transmission lines. It also emphasizes that private electric suppliers are not authorized to sell or deliver electricity at retail in Nebraska and does not require consumer-owned electric suppliers to enter into joint agreements with private suppliers for facility development. The original section 70-1014.02 is repealed as part of this legislative update.
