1 A BILL FOR AN ACT relating to jails; to require reimbursement of counties
2 for jail expenses as prescribed; to provide powers and duties for
3 the Jail Standards Board; and to declare an emergency.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) On or before September 1, 2024, and on or before
2 each September 1 thereafter, each county that operates and maintains a
3 county jail shall certify to the Jail Standards Board the actual cost of
4 operating and maintaining such county jail in the preceding fiscal year.
5 The board shall have the authority to request or obtain additional
6 information and make a determination as to the actual cost of operating
7 and maintaining each county jail.
8 (2) No later than August 1 of the following year, the Jail Standards
9 Board shall reimburse each county for the actual cost of operating and
10 maintaining each county jail in such county.
11 (3) The expenses of operating and maintaining a county jail shall
12 not be reimbursable under this section if the operation and maintenance
13 of the jail does not conform to the rules and regulations and directions
14 of the Jail Standards Board.
15 Sec. 2. Since an emergency exists, this act takes effect when
16 passed and approved according to law.
