1 A BILL FOR AN ACT relating to schools; to require a school district to
2 cover certain costs of a student that transfers from such school
3 district as a result of discrimination as prescribed.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) A school district shall not discriminate against a
2 student of such school district, including through the use of excessive
3 disciplinary actions or the denial of special education services. If a
4 student that is discriminated against by a school district in violation
5 of this section decides to attend another school district as a result of
6 such discrimination, the school district that is in violation shall cover
7 any costs associated with the student attending the new school district,
8 up to an amount equal to two times the amount of foundation aid received
9 by such school district for such student under the Tax Equity and
10 Educational Opportunities Support Act.
11 (2) The State Board of Education may adopt and promulgate rules and
12 regulations to carry out this section.
