1 A BILL FOR AN ACT relating to the Military Installation Development and
2 Support Fund; to amend section 55-901, Revised Statutes Cumulative
3 Supplement, 2022, and section 84-612, Revised Statutes Supplement,
4 2023; to change the name of and approved uses for the Military
5 Installation Development and Support Fund; to define a term; to
6 harmonize provisions; and to repeal the original sections.

1 Section 1. Section 55-901, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 55-901 (1) The Military Installation Base Development and Support
4 Fund is created. The fund shall be used to contribute to construction,
5 development, or support for on any military installation base, located in
6 Nebraska, for purposes of improving mission retention and recruitment;
7 supporting the morale, health, and mental wellness of military members
8 and families; and growing the economic impact of military installations
9 bases in Nebraska. The Department of Veterans' Affairs shall administer
10 the fund. The fund shall consist of transfers authorized by the
11 Legislature and any gifts, grants, or bequests from any source, including
12 federal, state, public, and private sources, for such purposes. Any money
13 in the fund available for investment shall be invested by the state
14 investment officer pursuant to the Nebraska Capital Expansion Act and the
15 Nebraska State Funds Investment Act.
16 (2) The fund may be used for any project that directly supports any
17 military installation projects on military bases located in Nebraska. ,
18 including, but not limited to:
19 (a) An outdoor airman amenity pavilion;
20 (b) Track and field stadium improvements;
21 (c) A parade-ground walking trail;
22 (d) Improvements at Willow Lakes Golf Course;
23 (e) Base Lake improvements;
24 (f) Landscape enhancements;
25 (g) Deterrence Park;
26 (h) Looking Glass Heritage Park;
27 (i) Quarters 13 comprehensive repairs, design, and construction; and
28 (j) B1000 Rooftop Garden.
29 (3) The Department of Veterans' Affairs shall require a match of
30 private funding in an amount equal to or greater than one-half of the
31 total cost of any project described listed in subsection (2) of this

1 section prior to authorizing an expenditure from the fund.
2 (4) For purposes of this section, military installation means a
3 base, camp, post, station, yard, center, armory, or other activity under
4 the jurisdiction of the United States Department of Defense or the
5 Nebraska Military Department.
6 Sec. 2. Section 84-612, Revised Statutes Supplement, 2023, is
7 amended to read:
8 84-612 (1) There is hereby created within the state treasury a fund
9 known as the Cash Reserve Fund which shall be under the direction of the
10 State Treasurer. The fund shall only be used pursuant to this section.
11 (2) The State Treasurer shall transfer funds from the Cash Reserve
12 Fund to the General Fund upon certification by the Director of
13 Administrative Services that the current cash balance in the General Fund
14 is inadequate to meet current obligations. Such certification shall
15 include the dollar amount to be transferred. Any transfers made pursuant
16 to this subsection shall be reversed upon notification by the Director of
17 Administrative Services that sufficient funds are available.
18 (3) In addition to receiving transfers from other funds, the Cash
19 Reserve Fund shall receive federal funds received by the State of
20 Nebraska for undesignated general government purposes, federal revenue
21 sharing, or general fiscal relief of the state.
22 (4) The State Treasurer shall transfer two million dollars from the
23 Governor's Emergency Cash Fund to the Cash Reserve Fund on or before June
24 30, 2024, on such dates and in such amounts as directed by the budget
25 administrator of the budget division of the Department of Administrative
26 Services.
27 (5) The State Treasurer shall transfer two hundred sixteen million
28 one hundred twenty thousand dollars from the Cash Reserve Fund to the
29 Nebraska Capital Construction Fund on or after July 1, 2022, but before
30 June 15, 2023, on such dates and in such amounts as directed by the
31 budget administrator of the budget division of the Department of

1 Administrative Services.
2 (6) The State Treasurer shall transfer one hundred eighty-two
3 million six hundred twenty-three thousand eight hundred twenty-five
4 dollars from the Cash Reserve Fund to the Nebraska Capital Construction
5 Fund on or after July 1, 2023, but before June 30, 2024, on such dates
6 and in such amounts as directed by the budget administrator of the budget
7 division of the Department of Administrative Services.
8 (7) The State Treasurer shall transfer fifty-three million five
9 hundred thousand dollars from the Cash Reserve Fund to the Perkins County
10 Canal Project Fund on or before June 30, 2023, on such dates and in such
11 amounts as directed by the budget administrator of the budget division of
12 the Department of Administrative Services.
13 (8) No funds shall be transferred from the Cash Reserve Fund to
14 fulfill the obligations created under the Nebraska Property Tax Incentive
15 Act unless the balance in the Cash Reserve Fund after such transfer will
16 be at least equal to five hundred million dollars.
17 (9) The State Treasurer shall transfer thirty million dollars from
18 the Cash Reserve Fund to the Military Installation Base Development and
19 Support Fund on or before June 30, 2023, but not before July 1, 2022, on
20 such dates and in such amounts as directed by the budget administrator of
21 the budget division of the Department of Administrative Services.
22 (10) The State Treasurer shall transfer eight million three hundred
23 thousand dollars from the Cash Reserve Fund to the Trail Development and
24 Maintenance Fund on or after July 1, 2022, but before July 30, 2022, on
25 such dates and in such amounts as directed by the budget administrator of
26 the budget division of the Department of Administrative Services.
27 (11) The State Treasurer shall transfer fifty million dollars from
28 the Cash Reserve Fund to the Nebraska Rural Projects Fund on or after
29 July 1, 2022, but before July 15, 2023, on such dates and in such amounts
30 as directed by the budget administrator of the budget division of the
31 Department of Administrative Services.

1 (12) The State Treasurer shall transfer thirty million dollars from
2 the Cash Reserve Fund to the Rural Workforce Housing Investment Fund on
3 or after July 1, 2022, but before July 15, 2023, on such dates and in
4 such amounts as directed by the budget administrator of the budget
5 division of the Department of Administrative Services.
6 (13) The State Treasurer shall transfer twenty million dollars from
7 the Cash Reserve Fund to the Intern Nebraska Cash Fund on or after July
8 1, 2022, but before June 15, 2023, on such dates and in such amounts as
9 directed by the budget administrator of the budget division of the
10 Department of Administrative Services.
11 (14) The State Treasurer shall transfer twenty million dollars from
12 the Cash Reserve Fund to the Middle Income Workforce Housing Investment
13 Fund on July 15, 2022, or as soon thereafter as administratively
14 possible, and in such amounts as directed by the budget administrator of
15 the budget division of the Department of Administrative Services.
16 (15) The State Treasurer shall transfer eighty million dollars from
17 the Cash Reserve Fund to the Jobs and Economic Development Initiative
18 Fund on or after July 1, 2022, but before July 15, 2023, on such dates
19 and in such amounts as directed by the budget administrator of the budget
20 division of the Department of Administrative Services.
21 (16) The State Treasurer shall transfer twenty million dollars from
22 the Cash Reserve Fund to the Site and Building Development Fund on July
23 15, 2022, or as soon thereafter as administratively possible, and in such
24 amounts as directed by the budget administrator of the budget division of
25 the Department of Administrative Services.
26 (17) The State Treasurer shall transfer fifty million dollars from
27 the Cash Reserve Fund to the Surface Water Irrigation Infrastructure Fund
28 on or after July 15, 2022, but before January 1, 2023, on such dates and
29 in such amounts as directed by the budget administrator of the budget
30 division of the Department of Administrative Services.
31 (18) The State Treasurer shall transfer fifteen million dollars from

1 the Cash Reserve Fund to the Site and Building Development Fund on or
2 before June 30, 2022, on such dates and in such amounts as directed by
3 the budget administrator of the budget division of the Department of
4 Administrative Services.
5 (19) The State Treasurer shall transfer fifty-five million dollars
6 from the Cash Reserve Fund to the Economic Recovery Contingency Fund on
7 or before June 30, 2022, on such dates and in such amounts as directed by
8 the budget administrator of the budget division of the Department of
9 Administrative Services.
10 (20) The State Treasurer shall transfer ten million dollars from the
11 Cash Reserve Fund to the School Safety and Security Fund as soon as
12 administratively possible after September 2, 2023, on such dates and in
13 such amounts as directed by the budget administrator of the budget
14 division of the Department of Administrative Services.
15 (21) The State Treasurer shall transfer ten million dollars from the
16 Cash Reserve Fund to the General Fund as soon as administratively
17 possible after June 7, 2023, on such dates and in such amounts as
18 directed by the budget administrator of the budget division of the
19 Department of Administrative Services.
20 (22) The State Treasurer shall transfer one million dollars from the
21 Cash Reserve Fund to the Revitalize Rural Nebraska Fund as soon as
22 administratively possible after June 7, 2023, on such dates and in such
23 amounts as directed by the budget administrator of the budget division of
24 the Department of Administrative Services.
25 (23) The State Treasurer shall transfer three million dollars from
26 the Cash Reserve Fund to the Risk Loss Trust on or before June 30, 2024,
27 on such dates and in such amounts as directed by the budget administrator
28 of the budget division of the Department of Administrative Services.
29 (24) The State Treasurer shall transfer eleven million three hundred
30 twenty thousand dollars from the Cash Reserve Fund to the Health and
31 Human Services Cash Fund on or after July 1, 2023, but on or before June

1 30, 2024, on such dates and in such amounts as directed by the budget
2 administrator of the budget division of the Department of Administrative
3 Services.
4 (25) The State Treasurer shall transfer five hundred seventy-four
5 million five hundred thousand dollars from the Cash Reserve Fund to the
6 Perkins County Canal Project Fund on or before June 30, 2024, on such
7 dates and in such amounts as directed by the budget administrator of the
8 budget division of the Department of Administrative Services.
9 (26) The State Treasurer shall transfer one million four hundred
10 thousand dollars from the Cash Reserve Fund to the State Building
11 Revolving Fund on or before July 10, 2023, on such dates and in such
12 amounts as directed by the budget administrator of the budget division of
13 the Department of Administrative Services.
14 (27) The State Treasurer shall transfer one million one hundred
15 thousand dollars from the Cash Reserve Fund to the Accounting Division
16 Revolving Fund on or before July 10, 2023, on such dates and in such
17 amounts as directed by the budget administrator of the budget division of
18 the Department of Administrative Services.
19 (28) The State Treasurer shall transfer one million one hundred
20 fifteen thousand dollars from the Cash Reserve Fund to the Public Safety
21 Cash Fund on or after July 1, 2023, but before June 30, 2024, on such
22 dates and in such amounts as directed by the budget administrator of the
23 budget division of the Department of Administrative Services.
24 (29) The State Treasurer shall transfer one hundred million dollars
25 from the Cash Reserve Fund to the Roads Operations Cash Fund before June
26 30, 2023, on such dates and in such amounts as directed by the budget
27 administrator of the budget division of the Department of Administrative
28 Services.
29 (30) The State Treasurer shall transfer eighteen million seven
30 hundred fifty thousand dollars from the Cash Reserve Fund to the State
31 Self-Insured Indemnification Fund before June 30, 2023, on such dates and

1 in such amounts as directed by the budget administrator of the budget
2 division of the Department of Administrative Services.
3 (31) The State Treasurer shall transfer five million dollars from
4 the Cash Reserve Fund to the Nebraska Public Safety Communication System
5 Revolving Fund on or after July 1, 2023, but before June 30, 2024, on
6 such dates and in such amounts as directed by the budget administrator of
7 the budget division of the Department of Administrative Services.
8 (32) The State Treasurer shall transfer seventy million dollars from
9 the Cash Reserve Fund to the Shovel-Ready Capital Recovery and Investment
10 Fund on or after July 1, 2023, but before June 30, 2024, on such dates
11 and in such amounts as directed by the budget administrator of the budget
12 division of the Department of Administrative Services.
13 (33) The State Treasurer shall transfer two million dollars from the
14 Cash Reserve Fund to the Site and Building Development Fund on or after
15 July 1, 2023, but before June 30, 2024, on such dates and in such amounts
16 as directed by the budget administrator of the budget division of the
17 Department of Administrative Services.
18 (34) The State Treasurer shall transfer twenty million dollars from
19 the Cash Reserve Fund to the Economic Development Cash Fund on or after
20 July 1, 2023, but before June 30, 2024, on such dates and in such amounts
21 as directed by the budget administrator of the budget division of the
22 Department of Administrative Services.
23 (35) The State Treasurer shall transfer zero dollars from the Cash
24 Reserve Fund to the Rural Workforce Housing Investment Fund on or after
25 July 1, 2023, but before June 30, 2024, on such dates and in such amounts
26 as directed by the budget administrator of the budget division of the
