1 A BILL FOR AN ACT relating to appropriations; to state intent regarding
2 appropriations of Federal Funds allocated to the State of Nebraska
3 from the federal Coronavirus State Fiscal Recovery Fund pursuant to
4 the federal American Rescue Plan Act of 2021, 42 U.S.C. 802, as
5 amended; and to declare an emergency.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. It is the intent of the Legislature to appropriate (1)
2 $XXX from Federal Funds for FY2023-24 and (2) $XXX from Federal Funds for
3 FY2024-25 to XXXXX, for Program XXX.
4 The Federal Funds appropriated in this section are from the
5 unexpended and unencumbered appropriation balances of the Federal Funds
6 allocated to the State of Nebraska from the federal Coronavirus State
7 Fiscal Recovery Fund pursuant to the federal American Rescue Plan Act of
8 2021, 42 U.S.C. 802, as amended.
9 Sec. 2. It is the intent of the Legislature that the Auditor of
10 Public Accounts continue to exercise the exclusive authority to perform
11 the Statewide Single Audit for the Federal Funds allocated to the State
12 of Nebraska from the federal Coronavirus State Fiscal Recovery Fund
13 pursuant to the federal American Rescue Plan Act of 2021, 42 U.S.C. 802,
14 as amended, and all other federal funds appropriated for state programs,
15 doing so until the Legislature expressly directs otherwise and being
16 fully compensated for the cost of such audit work, on a pro rata basis,
17 by each agency audited.
18 Sec. 3. Since an emergency exists, this act takes effect when
19 passed and approved according to law.
