1 A BILL FOR AN ACT relating to lead service lines; to amend section
2 71-5328, Revised Statutes Supplement, 2023; to define terms; to
3 change provisions relating to the Lead Service Line Cash Fund; to
4 provide for certain grants; and to repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 71-5328, Revised Statutes Supplement, 2023, is
2 amended to read:
3 71-5328 (1) For purposes of this section:
4 (a) Department means the Department of Environment and Energy;
5 (b) Metropolitan utilities district means a district created
6 pursuant to section 14-2101; and
7 (c) Qualified labor training organization means any job training
8 service provider headquartered in the State of Nebraska with a
9 demonstrated history of providing workforce training relevant to the
10 skilled labor necessary for the removal and replacement of lead service
11 lines.
12 (2) The Lead Service Line Cash Fund is created. The fund shall be
13 administered by the department Department of Environment and Energy. The
14 fund shall consist of funds transferred by the Legislature. The fund
15 shall be used for grants under subsections (3) and (4) of this section to
16 utilities districts to expedite the replacement of homeowner-owned lead
17 service lines. Any money in the fund available for investment shall be
18 invested by the state investment officer pursuant to the Nebraska Capital
19 Expansion Act and the Nebraska State Funds Investment Act.
20 (3) The department shall utilize not more than twenty percent of the
21 money in the Lead Service Line Cash Fund for the purpose of providing
22 grants to qualified labor training organizations for the following:
23 (a) Infrastructure expenditures necessary to establish a lead
24 service line training facility or for any expenditures necessary to
25 establish a lead service line training program; or
26 (b) Labor training or any educational programming expenditures
27 necessary to provide the proper trade skills necessary for laborers and
28 plumbers to replace lead service lines.
29 (4) The department shall utilize all remaining money in the Lead
30 Service Line Cash Fund for the purpose of providing grants to
31 metropolitan utilities districts for the following:

1 (a) Removing and replacing lead service lines;
2 (b) Repaying debt incurred for any loan received by the metropolitan
3 utilities district for the purpose of replacing lead service lines,
4 including any loan or loans under the federal Drinking Water State
5 Revolving Fund or any other loan incurred specifically for the purpose of
6 removing lead service lines;
7 (c) Providing information to residents on the benefits of removing
8 lead service lines;
9 (d) Performing necessary construction, assessment, mapping, or any
10 other labor, management, or contracted services required for and
11 associated with removing and replacing lead service lines; or
12 (e) Acquiring any equipment, materials, or supplies necessary to
13 replace lead service lines.
14 (5) The department may adopt and promulgate rules and regulations to
15 carry out this section.
16 Sec. 2. Original section 71-5328, Revised Statutes Supplement,
17 2023, is repealed.
