1 A BILL FOR AN ACT relating to schools; to require school districts to
2 provide menstrual products to students as prescribed; to define
3 terms; to limit liability; and to provide powers and duties to
4 school districts, the State Department of Education, and the State
5 Board of Education.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. For purposes of sections 1 to 6 of this act:
2 (1) Dispenser means a product or system installed or placed in a
3 school bathroom for the purpose of dispensing menstrual products free of
4 charge. A dispenser may include simple systems such as a basket;
5 (2) Menstrual products means period products used during
6 menstruation, including pads and tampons;
7 (3) Public school building means a building used by a school
8 district to provide educational services to middle school or high school
9 students; and
10 (4) School bathroom means a female or single-use bathroom in a
11 public school building and includes a female locker room if such locker
12 room includes toilet facilities.
13 Sec. 2. (1) Beginning with the 2025-26 school year, the State
14 Department of Education shall make available to each school district the
15 appropriate number of menstrual products and dispensers required by each
16 school district pursuant to section 3 of this act.
17 (2) The State Board of Education shall develop a formula for use by
18 school districts in determining the appropriate number of menstrual
19 products to request for each public school building based on the number
20 of school bathrooms in the public school building, number of students of
21 menstruating age attending the school building, and the average number of
22 menstrual hygiene products that would be necessary during a school day
23 for such students.
24 (3) The State Board of Education shall develop a framework for
25 school districts to request and receive menstrual products and
26 dispensers.
27 (4) The State Department of Education shall track distributions to
28 each school district to establish need and forecast future procurement.
29 Sec. 3. (1) Beginning in school year 2025-26, a school district
30 shall ensure that dispensers supplied with free menstrual products,
31 including both pads and tampons, are available for use at each school

2 (2) Each school district shall request to the State Department of
3 Education by X, XX, XXXX, of each year, on forms and in a manner
4 prescribed by the department, the number of menstrual products requested
5 for the next school year to ensure menstrual products are available as
6 provided in subsection (1) of this section according to the formula
7 developed pursuant to subsection (2) of section 2 of this act.
8 (3) A school district or an administrator at each public school
9 building may determine the best placement of a dispenser in each school
10 bathroom and appropriate refill methods.
11 (4) A school board or board of education may adopt a policy relating
12 to the requirements of this section.
13 Sec. 4. A school district or any employee of such school district
14 shall not be liable in a criminal action or for civil damages as a result
15 of student's use of menstrual products made available pursuant to section
16 3 of this act.
17 Sec. 5. Beginning in fiscal year 2024-25, it is the intent of the
18 Legislature that General Funds in an amount not to exceed XXXX dollars be
19 appropriated to carry out sections 1 to 6 of this act.
20 Sec. 6. The State Board of Education may adopt and promulgate rules
21 and regulations to carry out sections 1 to 6 of this act.
