1 A BILL FOR AN ACT relating to the Shovel-Ready Capital Recovery and
2 Investment Act; to amend section 81-12,221, Revised Statutes
3 Supplement, 2023; to redefine a term; and to repeal the original
4 section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 81-12,221, Revised Statutes Supplement, 2023, is
2 amended to read:
3 81-12,221 For purposes of the Shovel-Ready Capital Recovery and
4 Investment Act:
5 (1) Capital project means a construction project to build, expand,
6 or develop a new or existing facility or facilities or restoration work
7 on a facility designated as a National Historic Landmark;
8 (2) Cost, in the context of a capital project, means the cost of
9 land, engineering, architectural planning, contract services,
10 construction, materials, and equipment needed to complete the capital
11 project;
12 (3) COVID-19 means the novel coronavirus identified as SARS-CoV-2,
13 the disease caused by the novel coronavirus SARS-CoV-2 or a virus
14 mutating therefrom, and the health conditions or threats associated with
15 the disease caused by the novel coronavirus SARS-CoV-2 or a virus
16 mutating therefrom;
17 (4) Department means the Department of Economic Development;
18 (5) Qualified nonprofit organization means a tax-exempt organization
19 under section 501(c)(3) of the Internal Revenue Code that:
20 (a) Is related to arts, culture, or the humanities, including any
21 organization formed for the purpose of developing and promoting the work
22 of artists and the humanities in various visual and performing forms,
23 such as film, sculpture, dance, painting, horticulture, multimedia,
24 poetry, photography, performing arts, zoology, or botany;
25 (b) Operates a sports complex;
26 (c) Is a postsecondary educational institution in a city of the
27 metropolitan class and partners with an organization hosting a regional
28 or national event for purposes of infrastructure development related to
29 furnishing and equipment for a health sciences education center, enhanced
30 mobility by vacation of a public street, pedestrian safety, and
31 construction of a community athletic complex; or

1 (d) Is a county agricultural society with facilities located within
2 the boundaries of a city of the primary class; or
3 (e) Operates a multi-function center which provides facilities to
4 the public for at least two of the following uses:
5 (i) As an early childhood learning center;
6 (ii) As a community event center; or
7 (iii) As an indoor and outdoor sports training center;
8 (6) Sports complex means property that:
9 (a) Includes indoor areas, outdoor areas, or both;
10 (b) Is primarily used for competitive sports; and
11 (c) Contains multiple separate sports venues; and
12 (7) Sports venue includes, but is not limited to:
13 (a) A baseball field;
14 (b) A softball field;
15 (c) A soccer field;
16 (d) An outdoor stadium primarily used for competitive sports;
17 (e) An outdoor arena primarily used for competitive sports; and
18 (f) An enclosed, temperature-controlled building primarily used for
19 competitive sports.
20 Sec. 2. Original section 81-12,221, Revised Statutes Supplement,
21 2023, is repealed.
