1 A BILL FOR AN ACT relating to schools; to amend section 79-10,137,
2 Reissue Revised Statutes of Nebraska; to require the Department of
3 Health and Human Services to establish the Summer Electronic
4 Benefits Transfer program; to repeal the original section; and to
5 declare an emergency.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 79-10,137, Reissue Revised Statutes of Nebraska,
2 is amended to read:
3 79-10,137 The Legislature finds that, for Nebraska to compete
4 effectively in the world, it must have an educated and productive work
5 force. In order to have an educated and productive work force, it must
6 prepare its children to learn, and in order to do so the children must be
7 well-nourished. The Legislature finds that school breakfast and lunch
8 programs are integral parts of Nebraska's educational system. The
9 Legislature finds that summer meal programs are an integral part of
10 Nebraska's educational system.
11 Sec. 2. To ensure children in Nebraska have access to food during
12 the summer months, the Department of Health and Human Services shall opt
13 into the provision of the federal Consolidated Appropriations Act of 2023
14 to permanently authorize the Summer Electronic Benefits Transfer program.
15 Sec. 3. Original section 79-10,137, Reissue Revised Statutes of
16 Nebraska, is repealed.
17 Sec. 4. Since an emergency exists, this act takes effect when
18 passed and approved according to law.
