1 A BILL FOR AN ACT relating to public assistance; to amend section 68-996,
2 Revised Statutes Cumulative Supplement, 2022; to provide for use of
3 the Medicaid Managed Care Excess Profit Fund for behavioral health
4 needs of adults and children as prescribed; and to repeal the
5 original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 68-996, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 68-996 The Medicaid Managed Care Excess Profit Fund is created. The
4 fund shall contain money returned to the State Treasurer pursuant to
5 subdivision (3) of section 68-995. The fund shall first be used to offset
6 any losses under subdivision (2) of section 68-995 and then to provide
7 for services addressing the behavioral health needs of adults and
8 children under the Medical Assistance Act by increasing behavioral health
9 service rates in order to increase , including filling service gaps,
10 providing system improvements, and sustaining access to care as
11 determined by the Legislature. The fund shall only be used for the
12 purposes described in this section. Any money in the fund available for
13 investment shall be invested by the state investment officer pursuant to
14 the Nebraska Capital Expansion Act and the Nebraska State Funds
15 Investment Act.
16 Sec. 2. Original section 68-996, Revised Statutes Cumulative
17 Supplement, 2022, is repealed.
