1 A BILL FOR AN ACT relating to the Uninsured and Underinsured Motorist
2 Insurance Coverage Act; to amend section 44-6401, Reissue Revised
3 Statutes of Nebraska; to authorize provisions in contracts reducing
4 the limitations period for insured claims; to harmonize provisions;
5 and to repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 44-6401, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 44-6401 Sections 44-6401 to 44-6414 and section 2 of this act shall
4 be known and may be cited as the Uninsured and Underinsured Motorist
5 Insurance Coverage Act.
6 Sec. 2. (1) In furtherance of general contract principles, the
7 parties to a contract providing uninsured or underinsured motorist
8 coverage are free to contract to any reasonable terms, including, but not
9 limited to, reducing the time period in which any suit seeking recovery
10 under such coverage may be instituted.
11 (2) This section does not:
12 (a) Authorize the inclusion of contract provisions prohibited by the
13 Uninsured and Underinsured Motorist Insurance Coverage Act or by any
14 provision of Chapter 44; or
15 (b) Allow for the exclusion of any contract provision required by
16 the Uninsured and Underinsured Motorist Insurance Coverage Act.
17 Sec. 3. Original section 44-6401, Reissue Revised Statutes of
18 Nebraska, is repealed.
