1 A BILL FOR AN ACT relating to nonprofit organizations; to adopt the
2 Nebraska Nonprofit Security Grant Program Act.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. Sections 1 to 6 of this act shall be known and may be
2 cited as the Nebraska Nonprofit Security Grant Program Act.
3 Sec. 2. For purposes of the Nebraska Nonprofit Security Grant
4 Program Act:
5 (1) Agency means the Nebraska Emergency Management Agency;
6 (2) Equipment means security equipment installed on real property,
7 including any building or improvement, that is owned or leased by the
8 nonprofit organization, including reinforced doors and gates, perimeter
9 lighting, exterior and interior door locking systems, alarm systems,
10 camera-based security systems, access-control systems, blast-resistant
11 film for windows or shatter-resistant glass, lock-down systems, public-
12 address systems, high-intensity lighting and alarms, and inspection and
13 screening systems;
14 (3) Planning means those activities that are related to protecting a
15 facility, the people within the facility, and the people with access to
16 the facility and providing for their functional needs. The term includes
17 developing and enhancing a nonprofit organization's security plans and
18 protocols, emergency contingency plans, and evacuation or shelter-in-
19 place plans and the materials that are required to conduct planning
20 activities;
21 (4) Program means the Nebraska Nonprofit Security Grant Program
22 created in section 3 of this act;
23 (5) Qualified nonprofit organization means an organization that:
24 (a) Is exempt from federal income taxes under section 501(c)(3) of
25 the Internal Revenue Code of 1986, including any nonprofit organization
26 created exclusively for religious purposes;
27 (b) Is at high risk of a terrorist attack or at risk for hate crimes
28 or attacks because of the nonprofit organization's ideology, beliefs, or
29 mission; and
30 (c)(i) Has applied for a federal nonprofit security grant and has
31 not received funding for the same year the applicant is applying for a

1 state grant under the program; or
2 (ii) Has been unable to apply for a federal nonprofit security grant
3 due to an inability to fund the request up front and wait for
4 reimbursement;
5 (6) Security personnel includes personnel who are contracted with or
6 employed by the nonprofit organization; and
7 (7) Training means training that addresses a specific security
8 threat or vulnerability. The term includes:
9 (a) Attendance and travel fees for training the nonprofit
10 organization's staff or members;
11 (b) Security training and exercises or drills, including active
12 shooter and shelter-in-place training, for the nonprofit organization's
13 staff, members, and visitors; and
14 (c) Training-related expenses, including supplies, materials, and
15 training equipment.
16 Sec. 3. (1) The Nebraska Nonprofit Security Grant Program is
17 created. The program shall be administered by the Nebraska Emergency
18 Management Agency.
19 (2) Any qualified nonprofit organization shall be eligible to
20 receive a grant under the program.
21 (3) In order to receive a grant, a qualified nonprofit organization
22 shall submit an application to the agency on a form prescribed by the
23 agency. The agency may accept an application submitted to the federal
24 government for a federal nonprofit security grant instead of the state
25 application prescribed by the agency if the applicant applied for a
26 federal nonprofit security grant and did not receive funding for the same
27 year the applicant is applying for a grant under this section.
28 (4) Grant funds may be used for target hardening and other safety
29 and security projects that mitigate vulnerabilities identified in a
30 vulnerability assessment completed by the qualified nonprofit
31 organization or by a vendor with whom the qualified nonprofit

1 organization has contracted, including projects involving:
2 (a) Planning;
3 (b) Equipment;
4 (c) Training; or
5 (d) Security personnel.
6 (5) The agency may prescribe requirements for vulnerability
7 assessments and may allow other target hardening and safety and security
8 projects to qualify for grant funding in addition to those activities
9 described in subsection (4) of this section.
10 (6) The agency may begin issuing grants under the program on January
11 1, 2025.
12 (7) The agency may award up to five hundred thousand dollars in
13 grants per year. A qualified nonprofit organization shall not receive
14 more than one hundred thousand dollars in grants in any one year.
15 Sec. 4. (1) Grant funds shall not be used to supplant a qualified
16 nonprofit organization's current expenses for target hardening or other
17 safety and security projects, but may be used for additional needs beyond
18 the organization's current expenses.
19 (2) A qualified nonprofit organization shall not use grant funds to
20 purchase equipment for security personnel.
21 Sec. 5. It is the intent of the Legislature to appropriate five
22 hundred thousand dollars from the General Fund beginning in fiscal year
23 2024-25 through fiscal year 2028-29 to carry out the Nebraska Nonprofit
24 Security Grant Program Act.
25 Sec. 6. The agency may adopt and promulgate rules and regulations
26 to carry out the Nebraska Nonprofit Security Grant Program Act.
