1 A BILL FOR AN ACT relating to government; to amend section 84-168,
2 Reissue Revised Statutes of Nebraska; to authorize acceptance of
3 cession or retrocession of federal jurisdiction for juvenile
4 matters; to change provisions and provide duties relating to such
5 acceptance; to authorize certain agreements; and to repeal the
6 original section.
7 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 84-168, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 84-168 (1) By appropriate executive order, the Governor may accept
4 on behalf of the state full or partial cession or retrocession of federal
5 jurisdiction, including criminal, or civil, or juvenile, over any lands,
6 except Indian lands, in federal enclaves within the state where such
7 cession or retrocession has been offered by appropriate federal
8 authority.
9 (2) To be accepted by the Governor, such offer must:
10 (a) Clearly state the subject matter of the offer, including
11 specifically identifying whether it includes matters of criminal, civil,
12 or juvenile jurisdiction and the scope of any concurrent jurisdiction;
13 (b) Provide a metes and bounds description of the boundaries; and
14 (c) Indicate whether the offer includes future contiguous expansions
15 of land acquired for military purposes.
16 (3) An executive order accepting a cession or retrocession of
17 jurisdiction shall be filed in the office of the Secretary of State and
18 in the office of the register of deeds of the county in which the
19 affected real estate is located. Upon filing, the Governor shall cause a
20 certified copy of the executive order and any documents filed under this
21 subsection to be sent to the appropriate federal authority.
22 (4) If an area of concurrent jurisdiction between the state and the
23 federal government is established pursuant to this section, any state
24 agency or political subdivision may enter into a memorandum of
25 understanding with any federal agency for coordination and designation of
26 responsibilities relating to such concurrent jurisdiction.
27 Sec. 2. Original section 84-168, Reissue Revised Statutes of
28 Nebraska, is repealed.
